You also acknowledge that subastAI operates based on information from auction organizations, and if we cannot access complete information from these sources, it may temporarily or permanently affect our services. In such cases, we do not offer refunds for annual or monthly subscription plans.
1.2. By registering for or using any subastAI service, you accept these Terms and all related policies for our services, including our privacy policy, data processing practices, and any additional documents published on our platform.
1.3. By accepting these Terms, you commit to using subastAI services and information responsibly and in accordance with applicable laws and regulations.
1.4. Our services are governed by (i) these Terms, (ii) any specific conditions that may be published on our platform and which may update or modify these Terms, and (iii) applicable laws and regulations. You acknowledge that subastAI may modify features, terms, or pricing at any time with appropriate notice. Continued use of our platform after such changes indicates your acceptance of the modifications.
1.5. subastAI reserves the right to modify the appearance, functionality, and content of our platform, as well as the terms for access and use, whenever we deem necessary to improve service quality or comply with regulations. We will communicate any changes to these Terms to users, and continued use of our platform after changes take effect constitutes acceptance.

3. Platform Use and Services
3.1. subastAI provides a digital platform designed to help users access and manage personalized alerts for public auctions. Our services offer relevant information about auctions you may be interested in, along with additional tools to enhance your auction experience. Our main services include Auction Alerts, where users can create personalized alerts based on criteria such as asset type (houses, cars, etc.), location, value, deposit amount, and keywords. These alerts are sent via email according to your preferences.
3.2. Key features of subastAI services include: Personalized Alerts - You can configure specific alerts to receive notifications about auctions matching your criteria. These notifications include detailed information about auctions, such as location, asset type, and current status.
3.3. subastAI also offers advanced tools to facilitate auction participation, such as saving auctions as favorites, adding comments, viewing auctions on a map, and accessing your alert history. These features are designed to improve your experience and help you better manage auction information.
3.4. subastAI provides services based on information obtained from official organizations and third-party sources. If we cannot access complete information from these sources, we cannot guarantee the availability or accuracy of data provided in our alerts. In such situations, our no-refund policy applies as outlined in these Terms.
3.5. subastAI also operates through a distributor model, where third parties can offer our service through promotional codes or commercial partnerships. These distributors receive compensation for each new client who registers and contracts a service. However, direct account management and billing remain subastAI's responsibility.
3.6. AI Analysis Limitations and Liability: subastAI utilizes artificial intelligence systems to assist in analyzing auction data and providing insights. However, AI systems are not infallible and may produce inaccurate, incomplete, or erroneous results. AI-generated analysis, reports, valuations, and recommendations are provided for informational purposes only and should not be considered as professional advice, financial guidance, or legal counsel. Users acknowledge that AI systems can make mistakes, have limitations, and should not be relied upon as a substitute for professional judgment, due diligence, or expert consultation. subastAI shall not be liable for any decisions, actions, or outcomes resulting from the use of AI-generated content, analysis, or recommendations. Users are solely responsible for verifying all information and making independent decisions regarding auction participation.
4. Account Registration
4.1. To access subastAI services, you must first create a personal account. This registration allows you to manage and configure personalized auction alerts, access real estate valuations and notes, and use other platform services.
4.2. You guarantee that information provided during registration is accurate, complete, and truthful. Any errors, inaccuracies, or outdated information in your provided data are your responsibility. subastAI is not liable for problems arising from inaccurate information you provide.
4.3. To register on our platform, you must create an account by providing your email address and other basic identification information necessary for service provision. For paid services, you must also provide valid and up-to-date payment information.
4.4. User registration on subastAI is completed directly through our website by following the instructions in the registration form. Once completed, you will receive an email to confirm account activation.
4.5. subastAI cannot guarantee the identity of registered users and assumes no responsibility for unauthorized third-party use of registered accounts. You are solely responsible for all activities performed through your account.
4.6. You are responsible for maintaining the confidentiality of your password and any platform access information. You must immediately notify subastAI of any unauthorized account use or security breach of which you become aware.
4.7. Any platform use performed using your password and access data will be considered performed by you. You are responsible for actions under your account, including unauthorized third-party use if you have not adopted necessary protection measures.
4.8. subastAI reserves the right to reject any registration request or cancel previously accepted registrations without providing reasons and without creating compensation or indemnification rights for the user. This includes, but is not limited to, duplicate accounts, false information, or misuse of our services.
5. Pricing and Payment
5.1. subastAI's payment system is governed by current pricing policies published on our platform website. These policies determine applicable rates for each user for service use, including creating personalized auction alerts and other additional services offered by subastAI. In our direct business-to-consumer model, subastAI sells services directly to clients. Our services may include Auction Alerts - A subscription service allowing users to receive notifications about public auctions matching their search criteria. Payment is made through our platform via subscription model for recurring services or one-time payment for individual services, managed through debit/credit card or other enabled payment methods. Payments are processed by an external payment provider enabled for recurring charges in subscription services.
5.2. Service prices may vary based on your selected plan (monthly or annual) and chosen services. subastAI may offer special rates or discounts, which will be properly announced on our website and subject to specific promotion terms. Subscription Plan - Users opting for monthly, quarterly, or annual subscription plans for auction alerts pay a fixed fee for access to these functionalities. Cost may vary based on the number of personalized alerts you wish to create or access to additional auction information.
5.3. The applicable rates for services you contract will be those in effect at the time of contracting. subastAI reserves the right to modify service prices at any time. If we modify prices for an active subscription plan, users will be notified in advance and may cancel their subscription if they disagree with new rates. Modified rates apply only from the next billing cycle and do not affect payments already made.
5.4. Payment for recurring services (subscriptions) is processed at the beginning of each billing period (monthly or annual), and you will be informed of any payment-related issues. For one-time services, charging occurs immediately after purchase confirmation. If a payment issue is detected (e.g., insufficient funds or credit card problems), you will be notified to resolve the situation. Meanwhile, access to contracted services may be restricted until resolved. If not resolved within 10/30 days maximum, the subscription may be automatically canceled.
6. Refund Policy
6.1. subastAI offers a 7-day money-back guarantee. If after registering on subastAI you decide our service doesn't meet your needs, you may request subscription cancellation and a corresponding refund. To process cancellation, send an email to support@subastai.app within 7 days of registration.
6.2. Cancellation and Refund Process: To cancel your subscription and request a refund, please provide: Your billing information (name, transaction ID, etc.), The email address used for registration, A brief explanation of your refund reason.
6.3. Refund Processing: As long as your request is made within 7 days of contracting, the amount will be refunded. Refund requests are processed within 10 days of receipt. Refunds are processed through the same payment method used for the original payment.
7. Free Credits and Service Cancellation
7.1. Free Credits: subastAI, at our sole discretion, may provide free credits to certain users for promotional purposes or as part of special offers. If free credits are granted, users will be informed of the specific terms and conditions, including what the credits can be used for, the validity period, and any applicable restrictions. Free credits are provided at subastAI's discretion and are not guaranteed to any user.
7.2. Free Credit Conditions: Free credits, when provided, may be used towards subscription fees or specific services as determined by subastAI. Credits have an expiration date as specified when granted and cannot be transferred, exchanged for cash, or combined with other offers unless explicitly stated. subastAI reserves the right to modify or revoke free credits at any time for any reason.
7.3. Account and Service Cancellation: Registered users may cancel their account at any time by sending a request to support@subastai.app or using the cancellation tool in their account control panel. subastAI will not provide refunds or credits for contracted services canceled before the subscription period end date. No refunds for partial service periods, service reductions/expansions, or unused services in active accounts.
8. License and Content
8.1. subastAI grants you a limited, non-exclusive, non-sublicensable, non-transferable, revocable license to access and use our platform and offered services. This license is solely for personal, non-commercial purposes and is subject to these Terms. Any use contrary to these Terms results in immediate license revocation without notice. You agree not to use our platform for commercial purposes or distribute, modify, reproduce, or transmit platform information without subastAI's express authorization.
8.2. By using our platform, you grant subastAI and collaborators a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, fully sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, perform, and display any content you send or upload to our platform, as related to services provided by subastAI. This includes, but is not limited to, auction-related information, attached documents like notes, auction edicts, property valuations, etc., and any other content you provide.
8.3. subastAI may retain content you provide as necessary to fulfill the purposes for which it was collected, in accordance with applicable data protection regulations.
8.4. You acknowledge and accept sole responsibility for content you provide or publish on our platform. subastAI is not liable to third parties for the truthfulness, accuracy, or legality of such content. You agree not to provide content that infringes third-party intellectual or industrial property rights, is defamatory, offensive, or contravenes applicable legislation. subastAI reserves the right to remove any content, information, or material published on our platform deemed inappropriate or infringing these Terms, applicable regulations, or third-party rights, without prior notification to you.
8.5. subastAI reserves the right to investigate any suspicious platform use conduct that potentially violates these Terms or applicable legislation. If subastAI detects illegal activities or third-party rights violations, we may take appropriate measures, including user access suspension or cancellation. subastAI will collaborate with competent authorities in illegal activity investigations, providing necessary information in accordance with applicable legal regulations.
9. User Obligations
9.1. If you become aware of illegal, unlawful content or potential intellectual or industrial property rights infringement on our platform, you must immediately notify subastAI via support@subastai.app. This allows subastAI to promptly remove or block such content. Using our platform for purposes other than those outlined in these Terms is expressly prohibited. subastAI is not liable for user misuse or platform manipulation.
9.2. You acknowledge that our platform may provide access to texts, graphics, designs, code, software, photos, images, expressions, and information belonging to subastAI or third parties. You assume responsibility for lawful, diligent, honest, and correct platform use, respecting good faith principles and complying with applicable legislation and these Terms.
9.3. You agree not to perform any of the following actions:
- Use false, inaccurate, incomplete, or outdated information when registering, access using another user's name/ID/credentials, or impersonate any person. You agree to inform subastAI of any data changes to keep information updated and truthful.
- Perform malicious, intentional, or negligent actions that harm, disable, or alter our platform, introduce viruses, malware, or harmful software, or attempt to scan, test vulnerabilities, or breach subastAI systems/networks security measures.
- Use our platform for fraudulent purposes or illegal activities, including money laundering, fraud, or other criminal activities.
- Copy, distribute, transform, modify, reproduce, or transmit platform-hosted information/documents/contents without authorization from the rights holder.
- Use our platform to send, store, or disseminate illegal, offensive, pornographic, abusive, defamatory, obscene, or threatening content that violates intellectual property, privacy, or other rights, including virus/spam/malicious code dissemination.
- Download, send, or distribute contents/applications that violate laws or infringe any person/entity rights, including intellectual/industrial/privacy rights.
- Promote or encourage third parties to perform prohibited/illegal practices detailed in this clause.
- Send or upload inappropriate content to our platform, including but not limited to: Defamatory, obscene, offensive, threatening material; Content promoting violence, hate, or discrimination by race, sex, religion, nationality, disability, sexual orientation, or age; Protected information by intellectual property/privacy/other rights without holder consent; Third-party personal data without explicit consent; Content promoting illegal activities, harassment, abuse, or privacy violation; Any content causing unnecessary distress/anxiety/alarm to others.
10. subastAI Responsibilities and Warranties
10.1. subastAI is not responsible for content, files, or information that users upload, share, or send via our platform. subastAI does not review or validate user-provided content, thus assumes no direct, indirect, or subsidiary responsibility for damages or losses from such content, communications, or user actions on our platform.
10.2. subastAI is not liable for:
Platform/service adequacy to your personal needs or expectations.
Any direct, indirect, or intangible damage, including personal injury, income loss, business interruption, reputation loss, or data loss from platform misuse.
Reputation or image loss or other consequences you may experience from using our platform.
Platform unavailability, maintenance, or effective operation. subastAI excludes liability for damages from unavailability or lack of continuity, to the maximum extent permitted by legislation.
Any platform technical defect, error, or malfunction affecting service access or use.
10.3. subastAI does not guarantee that your platform use always complies with these Terms, nor the identity or truthfulness of user-provided information. You accept that subastAI cannot control or assure other users' behavior or actions interacting on our platform.
10.4. subastAI reserves the right to admit or exclude any user from our platform at our discretion. Any user breaching these Terms or misusing our platform may be temporarily or permanently excluded without notice.
10.5. Content Modification and Removal Rights: subastAI reserves the right to delete, suspend, edit, or modify any platform content at any time without notice for any reason we deem appropriate; Delete, suspend, or block any user platform access if misuse or Terms breach is detected.
10.6. subastAI reserves the right to access, read, preserve, and disclose any platform information or content deemed necessary to: Comply with applicable laws, regulations, or judicial/governmental requirements; Enforce these Terms, including investigating potential breaches or illegal activities; Detect, prevent, or manage fraud, security, or technical issues; Respond to user assistance requests; Protect subastAI, users, or public rights, property, or safety.
10.7. subastAI declares that we have adopted all reasonable measures, within our possibilities and current technology, to ensure platform operation and avoid virus or other harmful component transmission to users. However, we cannot fully guarantee the absence of technical failures or absolute systems security, and are not liable for damages from such failures or cyberattacks.
11. Service Suspension and Cancellation
11.1. subastAI may temporarily suspend, without notice, platform access for maintenance, repair, updates, or improvements necessary for proper operation. subastAI will minimize interruptions and restore service as soon as possible.
11.2. subastAI reserves the right to delete, limit, or prevent platform access when technical difficulties, external problems, or circumstances beyond subastAI's control compromise security levels or adequate operation. Such measures may be taken without notice if necessary to protect service integrity.
11.3. subastAI is not liable for platform unavailability, maintenance, or effective operation, excluding liability for damages from lack of access, interruptions, or lack of continuity in platform operation, to the maximum extent permitted by legislation. You accept that platform access may be subject to technical or operational limitations beyond subastAI's control.
11.4. subastAI is also not responsible for platform service cancellation or suspension due to non-attributable causes. However, we commit to resolving any issues and offering user assistance for quick and satisfactory solutions.
11.5. subastAI is not liable for force majeure cases preventing platform use, such as Internet network blocks, third-party actions or omissions, natural disasters, labor conflicts, technological infrastructure failures, or any cause beyond subastAI's control that impedes normal service use.
11.6. Our platform may contain hyperlinks allowing access to third-party platforms or websites. subastAI is not responsible for content, information, or services on such sites, which are offered solely for informational purposes. The inclusion of such links implies no relationship, acceptance, or endorsement between subastAI and content or platform owners.
12. Information about Auctions and Responsibility
12.1. subastAI informs users that all information contained on the website, as well as any information received through other means provided by subastAI, is for informational purposes only. Users are responsible for verifying such information before taking any action related to auction participation.
12.2. subastAI does not offer, under any circumstances, the possibility of placing bids on any auctions advertised through our website. Users declare they are fully aware of this circumstance and hold subastAI harmless for any incidents, damages, or losses that may occur during the bidding process in auctions conducted by third parties advertised on our website.
12.3. As a recommendation, subastAI suggests that users properly inform themselves in advance about the functioning of any auction in which they intend to participate. Such information can be consulted on the websites of the organizations or entities organizing and managing the auctions.
13. Intellectual Property Rights
13.1. The platform (including, without limitation, its programming, editing, compilation and other elements necessary for its operation, designs, logos, texts, or graphics mentioned in these Terms) are the property of subastAI.
13.2. Users acknowledge that the reproduction, modification, distribution, commercialization, decompilation, disassembly, use of reverse engineering techniques, or any other means to obtain the source code, transformation, or unauthorized reference testing of any of the elements and utilities integrated into the development constitutes an infringement of subastAI's intellectual property rights, and agree not to perform any of the aforementioned actions.
13.3. All platform content is duly registered and protected under Intellectual Property and Industrial Property regulations, as well as being duly registered in the corresponding public registries. Total or partial reproduction, use, exploitation, distribution, and commercialization require prior express written authorization from subastAI.
13.4. Designs, logos, texts, or graphics unrelated to subastAI that may appear on the website or platform belong to their respective owners, who are solely responsible for any controversy that may arise regarding them.
13.5. Third-party holders of intellectual and industrial property rights over photographs, logos, and any other symbols or content included in the platform have granted the corresponding authorizations for their reproduction, distribution, and public communication.
14. Indemnity
14.1. Users agree to protect and indemnify subastAI from any damage, liability, or cost arising from third-party claims against subastAI due to material provided by users, misuse of subastAI services, or violation of these Terms.
14.2. subastAI will inform users of any claim through the data provided during registration. By accepting these Terms, users acknowledge that subastAI has no direct or indirect responsibility for services contracted between the client and each user or third parties.
15. Applicable Law and Jurisdiction
15.1. These Terms and Conditions shall be governed by and construed in accordance with Spanish law. For the resolution of any dispute or litigation that may arise between subastAI and the user derived from the use of the platform or the services offered, both parties expressly submit to the jurisdiction of the Courts and Tribunals of [Insert city, e.g., Madrid], expressly waiving any other jurisdiction that may correspond to them.
15.2. Before initiating any judicial procedure, the parties will attempt to resolve any dispute amicably through direct negotiation or mediation. If it is not possible to reach an agreement, the competent courts will be resorted to.

17.1. These Terms and Conditions constitute the complete agreement between the user and subastAI regarding the use of the platform and services offered, and replace any prior agreement or understanding, whether written or oral.
17.2. If any provision of these Terms is declared null, void, or unenforceable by any competent authority, the remaining provisions shall remain in full force and effect.
17.3. The tolerance or delay by subastAI in exercising any right or remedy provided in these Terms shall not constitute a waiver thereof.
17.4. These Terms may be modified by subastAI at any time, with the obligation to communicate such modifications to users. Continued use of the platform after the modifications take effect shall imply acceptance of the new Terms.
17.5. The user may not assign or transfer their rights or obligations under these Terms without the prior written consent of subastAI.
17.6. These Terms and Conditions take effect on the date 10th December 2025.
